Terms of Service
1. Acceptance
By accessing EterSoul VIP, you agree to these terms. If you do not agree, please do not use the service.
2. The Service
EterSoul VIP provides bespoke digital soul creation and hosting services. We craft personalised AI personas based on materials you provide.
3. Payment
All fees are paid in full at time of order. A first-year service fee waiver is included. From year two, annual service fees apply as stated in your plan.
4. Your Content & Rights Warranty
You retain ownership of all materials you upload (photos, voice recordings, text, documents). By providing content, you warrant that you hold all necessary rights to share it — including consent from any third party whose likeness, voice, writing, or personal information appears in your materials. You grant EterSoul a limited licence to use these materials solely for creating and maintaining your digital soul. EterSoul does not independently verify third-party consent and is not responsible for disputes arising from your provision of materials without proper authorisation.
5. Third-Party Likeness & Authorisation
EterSoul VIP creates memorial and companionship souls only for: (a) yourself; (b) your deceased immediate family members (spouse, parent, child, sibling), subject to relationship verification; or (c) a third party for whom you provide written authorisation, signed by that person if living, or by their lawful representative if deceased. We will not knowingly create souls of living public figures (celebrities, athletes, politicians) or of persons deceased within the last fifty (50) years without verified rights-holder consent. Orders that fail this check will be cancelled and refunded less verification costs.
6. AI-Generated Content Usage Limits
All replies, voice generations, persona snapshots, and Life Journal entries from your digital soul are produced by AI. They may be inaccurate, stylistically inconsistent, or outdated. AI-generated content is licensed to you for personal, non-commercial use — memorial, companionship, family communication. You may not (i) republish AI outputs as the verified statement, confession, or endorsement of any real person; (ii) use the soul commercially without a separate licence; (iii) deploy the soul in any context that could deceive a third party into believing they are communicating with the real person.
7. Privacy
Uploaded content is never shared with or used to train any other model. See our Privacy Policy for full details.
8. IP Infringement & Takedown
If you believe a soul on EterSoul infringes the rights of a person you legally represent, email [email protected] with: the soul URL or order number; your relationship to the person and evidence of authority (estate appointment, copyright registration, kinship certificate); the specific claim; and a statement under penalty of perjury that the information is accurate. We acknowledge within 48 hours and action verified requests within 14 days, typically by suspending the affected soul pending review. Contested cases are escalated to internal counsel.
9. Limitation of Liability
EterSoul's liability is limited to the amount paid for your order. We are not liable for indirect or consequential damages, including any liability arising from your provision of third-party materials without authorisation, or from misuse of AI-generated content by you or any party who obtains it through you.
10. Governing Law
These Terms of Service are governed by the laws of Singapore. Disputes will be resolved through binding arbitration in Singapore, except where local consumer-protection laws require otherwise.
